3. Subscription and Payment Terms

Online Games offers both free and premium subscription plans. By selecting a premium subscription, you agree to pay the subscription fees indicated for your selected plan. All payments are to be made in advance according to the pricing and terms displayed to you when you select your plan.

Subscription fees are non-refundable except as expressly set forth in these Terms or as required by applicable law. We may change the fees for subscriptions from time to time with reasonable advance notice. If you do not agree to the fee change, you have the right to reject the change by canceling your subscription before the fee change takes effect.

Unless you cancel your subscription before the end of the current billing cycle, we will automatically renew your subscription and charge the subscription fee to your payment method. You can cancel your subscription at any time through your account settings.

4. User Conduct

While using our platform, you agree not to:

Violate any applicable laws, regulations, or third-party rights
Use our platform for any illegal or unauthorized purpose
Attempt to gain unauthorized access to any portion of the platform or any other systems or networks connected to the platform
Use any automated means, including bots, scrapers, or spiders, to access the platform or collect content from the platform
Interfere with or disrupt the platform or servers or networks connected to the platform
Transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature
Create multiple accounts for abusive purposes
Engage in any activity that could disable, overburden, or impair the proper functioning of the platform
Use cheats, exploits, automation software, bots, hacks, mods, or any third-party software designed to modify or interfere with any gaming experience

5. Intellectual Property Rights

All content on the platform, including games, graphics, user interface, audio clips, video clips, editorial content, and the scripts and software used to implement the platform, is owned or licensed by Online Games and is protected by copyright, trademark, patent, and other intellectual property laws.

Online Games grants you a personal, non-exclusive, non-transferable, revocable license to use the platform for your personal, non-commercial entertainment purposes only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the platform.

6. User-Generated Content

Our platform may allow you to post, upload, publish, submit, or transmit content ("User Content"). By making any User Content available through the platform, you grant Online Games a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license with the right to sublicense, use, copy, modify, create derivative works of, distribute, publicly display, and publicly perform your User Content in connection with the operation and provision of the platform.

You represent and warrant that you own or have the necessary rights to all User Content that you post, and that such User Content, or its use by Online Games as contemplated by these Terms, does not violate these Terms, applicable law, or the intellectual property rights of any third party.

7. Disclaimer of Warranties

THE PLATFORM AND ALL CONTENT, MATERIALS, INFORMATION, SERVICES, AND PRODUCTS PROVIDED ON THE PLATFORM, ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, ONLINE GAMES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

ONLINE GAMES DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE PLATFORM OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ONLINE GAMES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, INCURRED DIRECTLY OR INDIRECTLY, OR LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM
ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM
ANY CONTENT OBTAINED FROM THE PLATFORM
UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF ONLINE GAMES EXCEED THE GREATER OF ONE HUNDRED EUROS (€100) OR THE AMOUNT YOU HAVE PAID ONLINE GAMES IN THE PAST TWELVE MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.

9. Indemnification

You agree to defend, indemnify, and hold harmless Online Games, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the platform, including, but not limited to, your User Content, any use of the platform's content, services, and products other than as expressly authorized in these Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Belgium, without giving effect to any principles of conflicts of law. Any dispute arising from or relating to these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts located in Brussels, Belgium.

11. Termination

We may terminate or suspend your account and access to the platform immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the platform will immediately cease.
